BERRY ONLINE 1-TO-1 TUITION

TERMS & CONDITIONS

1. GENERAL

1.1 By enrolling, the parent/guardian agrees to Berry Group Sdn. Bhd. (“the Company”) collecting and retaining personal information for student registration, administration, communication, and other legitimate purposes in accordance with applicable laws.

1.2 Registration and participation in Berry Online 1-to-1 Tuition constitute acceptance of these Terms & Conditions and the Company’s procedures.

2. REGISTRATION & ENROLMENT

2.1 All new students must complete the official registration form before commencing classes.

2.2 Enrolment is confirmed upon completion of registration and payment of the required fees.

2.3 Parents/guardians must provide the student’s identification details and required identification document for verification and registration purposes. Please refer to Appendix A.

3. PAYMENT

3.1 The full tuition fee for the following month must be paid by the 28th of each month. The Company reserves the right to suspend classes if payment is not received by the deadline.

3.2 Overpayments are non-refundable and will be carried forward to the following month.

3.3 Any concerns regarding the tuition amount or payment records should be raised with the Company for clarification.

4. COMMUNICATION

4.1 For trial classes, all communication with teachers must be through the Company.

4.2 For regular classes, once the student has confirmed their enrolment after attending a trial class, an official WhatsApp group may be created to facilitate communication regarding class schedules, lessons, materials, and other relevant updates.

4.3 Teachers’ personal information and contact details are confidential and must not be shared with third parties without the Company’s


5. CLASS ARRANGEMENTS

5.1 Class Arrangements (Berry Calendar)

5.2 Attendance & Rescheduling

a. Parents/teachers are encouraged to minimise cancellations to ensure consistent learning progress.

b. Classes generally continue during Berry Holidays (refer to yellow-marked dates on the calendar above) unless a rescheduling arrangement is agreed upon.

c. Rescheduling requests must be made:

• At least 1 day in advance for planned matters (e.g. travel, events); or

• At least 4 hours before class for urgent matters.

d. Absence without proper notice may be considered an attended class and may not be replaced.

e. If a student is more than 10 minutes late, the class may be considered cancelled and marked as attended. The Company may provide an exception for the first occurrence at its discretion.

f. If a teacher is more than 10 minutes late, the parent/student may request to cancel or reschedule the class.

5.3 Public Holidays

There will generally be no classes on public holidays. If a class falls on a public holiday, a replacement

class will be arranged unless both the teacher and student/parent agree for the class to proceed.

5.4 Replacement Classes

a. Approved replacement classes must be completed within 4 weeks from the original class

date.

b. Replacement classes are subject to teacher & student availability.

c. Unused replacement classes (Missed without proper notice) may be forfeited unless

otherwise approved by the Company.

6. TERMINATION

6.1 Tuition termination requires at least 4 weeks (28 days) advance notice.

6.2 If tuition is terminated after payment has been made without the required notice, 85% of the applicable paid tuition fee may be refunded, subject to any outstanding amounts or adjustments.

6.3 The Company may terminate tuition immediately in cases involving unauthorised sharing of a teacher’s personal contact details, harassment, serious misconduct, or serious/repeated breaches of these Terms.

6.4 Any dispute should first be raised with the Company for resolution. The Company’s decision regarding the administration of the programme shall be final, subject to applicable laws.

7. AMENDMENTS

7.1 The Company reserves the right to amend these Terms & Conditions when necessary.

7.2 Updated terms will be communicated through the Company’s official channels.

APPENDIX A

STUDENT IDENTIFICATION & DATA PRIVACY

1. Purpose of Collecting Identification Details

a. Identity verification and prevention of duplicate student records;

b. Accurate student records and registration; and

c. Future official documents, such as certificates or transcripts, where applicable.

2. Privacy

Identification documents and personal information will be used for legitimate student registration, administration, verification, and tuition-related purposes.

The Company will take reasonable measures to protect the information and will handle it in accordance with applicable data protection laws.

3. Registered Education Centre

Berry Group Sdn. Bhd. operates as a registered education centre and holds the relevant education licence. A copy of the licence may be provided to parents/guardians upon request.
